GOLDEN TICKET PROMOTION JANUARY 2019

TERMS AND CONDITIONS AND CONSUMER RULES (“Rules”)

  1. Entrants

Each entrant must be aged sixteen (16) years or over and a Danish resident to participate in the Hart Bageri Golden Ticket Promotion (“Promotion”). The following are not eligible to participate: (a) Employees and immediate family members of employees of Fresh Out The Oven ApS (the “Promoter”), (b) other persons assisting with this Promotion, (c) any syndicate or collection of persons acting in concert, and (d) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.

  1. Duration

The Promotion is scheduled to take place from 14th January 2019 to 31stJanuary 2019 (inclusive) (the “Promotional Period”) at Hart Bageri, a business located at Gammel Kongevej 109, 1850 Frederiksberg, Denmark (“Hart Bageri”). These dates and the deadline for prize claims (as described in these Rules) may be extended by the Promoter, and Entrants should check for details of changes on the Hart Bageri website at www.hartbageri.com.

  1. How to Enter

Customers can obtain an Instant Win Gold Card (“Card/s”) with the purchase of a whole loaf of City Loaf bread from Hart Bageri.

Hart Bageri has produced a total of eighteen (18) Cards for distribution.

It is mandatory to present a winning Card and the Entrant’s proof of purchase (“Receipt”) to a Hart Bageri employee as part of the Prize claim.

Presentation of a winning Card is a pre-condition to the prize claim being verified and awarded. Please make sure Cards are kept safe and undamaged. Failure to do this may result in the Promoter determining (at its sole discretion) that a Card and the associated prize claim is Void.

The Promoter will only process and award those Prize claims received between 14th January 2019 and 11th February 2019 (inclusive).

  1. Distribution of Cards

All Cards will be distributed by the Promoter on a random basis within whole loaves of City Loaf bread produced and sold at Hart Bageri. One Card will be distributed per day during the Promotional Period. 

  1. Prize Descriptions and Conditions

There are eighteen (18) Prizes that correspond to those eighteen (18) Cards to be distributed by the Promoter as part of the Promotion.

Each Card shall entitle the associated winning Entrant to claim one (1) free whole loaf of bread per week for those remaining 2019 calendar weeks that follow the successful verification and award of their Prize Claim (“Prize/s”).

All Prizes must be redeemed at Hart Bageri.

A Winner’s weekly redemption of the Prize is subject to the availability of each item and is subject to the normal operating hours of Hart Bageri. In the event that a Winner’s chosen item is unavailable at the time of redemption, the Promoter may ask the Winner to select another item or return on the following day to redeem their Prize.

Where a person wishes to redeem a Prize on behalf of a Winner, the Hart Bageri staff reserve the right to require sight of the Winner before redeeming the Prize for that other person.

Prizes may not be exchanged for any cash or other alternative, and Cards or Prizes are not transferable, divisible or permitted to be sold or resold.

For any Prize which must be claimed by a Winner’s parent/legal guardian, the Promoter will not be obliged to award it to anyone other than that parent/legal guardian, if the winner is under 18.

The Promoter shall notbe under any obligation to enquire whether the person submitting a Card is the person entitled to make the claim or is otherwise eligible to claim the Prize.

By claiming a Prize, the Winner represents for the Winner and, if relevant, their companions sharing the Prize, that (in addition to agreeing to the Rules) each agrees to the terms and conditions relating to the Prize, any element of the Prize or the redemption of goods or services using the Prize.

All advertisements depicting the prizes and prize descriptions are illustrative rather than definitive. Any advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the normal retail-price for all prizes which are available to win; it does not thereby imply that any Prize will be awarded in the absence of a corresponding valid claim.

All unawarded or unclaimed Prizes will lapse if not the subject of valid claims and the award of which has been completed within the time limits as prescribed by these Rules and in any event by 4th February 2019 at the latest (unless otherwise specifically stated).

  1. Responsibility

To the fullest extent permitted by applicable law (but not otherwise) the Promoter assumes no responsibility and is not liable for: (a) the accuracy or otherwise of the Prize description, (b) the non-availability, loss, interception or interference with, late or non-receipt, corruption or damage of or to any entry, prize claim, Card, Prize or notification or other communication, (c) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a Prize, (iv) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a Prize, or (v) any actual or perceived loss of opportunity or damage arising in connection with the termination or suspension of the Promotion (or any part, feature or element of the Promotion) at any time and which suspension or termination is due to supervening circumstances beyond the Promoter’s control (although the Promoter will still honour any valid claims received prior to the termination or suspension).

  1. The Promoter’s Rights

The Promoter may (a) extend any time limit, exercise a right of discretion or waive any of the Rules where a person might otherwise have been disqualified or otherwise disadvantaged (without obliging the Promoter to extend any time limit, exercise a right of discretion or waive any Rule on any further occasion for that entrant or at all for any other person), (b) terminate or suspend the Promotion (or any part, feature or element of the Promotion) at any time due to supervening circumstances beyond the Promoter’s control including (without limit) those which the Promoter determines have or are likely to compromise the security or credibility of the Promotion (or the affected part, feature or element of it), and (c) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize). The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding and reference to the discretion of the Promoter shall mean its sole discretion.

  1. General

All instructions, rules and conditions on any advertising or promotional materials relating to this Promotion form part of the Rules.

To the extent that the Promoter publicises the Promotion on any social media platform such as Twitter, Snapchat or Facebook:

  • it shall not thereby be implied that the social media platform provider is jointly or solely sponsoring, endorsing or administering the Promotion,
  • each entrant hereby releases the social media platform-provider absolutely and unconditionally from responsibility for the Promotion,
  • each entrant understands that the entrant is alone responsible for ensuring that the content of any posting on social media and for sharing any post in other media, is done in a responsible manner and each entrant undertakes to take account before doing so of the suitability of the media and the age and other characteristics of its users for the posting, and
  • information supplied by any person via a social platform (including taking part in any poll or vote for marketing activity in support of the Promotion) is deemed to have been provided solely to the Promoter and not to the social media platform and on the prior understanding and acceptance that such information may be subject to use by the social platform-provider in accordance with its published terms of use.

The Promoter retains ownership of all Cards, and ownership or control of the trademarks and other intellectual property in and over the Cards, and all Promotion-advertising at all times (“the Promoter’s Property”), and the Promoter grants customers of Hart Bageri a licence to use the Promoter’s Property solely for the purposes of the proper participation in the Promotion in accordance with the Rules. None of the following shall be considered proper participation in the Promotion, namely; any sale, offer to sell, giving away or other dealing with any Cards, any use for any purpose whatsoever of any Promotion advertising or any feature taken from it or anything which is a breach of the Rules. Customers and participants may not assign this licence or any benefit under it. Any use of the Promoter’s Property for a purpose not stated to be permitted or any failure otherwise to observe any provision of this licence shall result in automatic termination of the licence without requirement as to notice and amount to an irremediable infringement of the Promoter’s intellectual property entitling the Promoter to all rights and remedies available by law.

All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.

Any Card/s, entry, prize claim and/or communication (including any marketing material or communication) made or received by the Promoter or an agent, will be invalid and void for all purposes if it is deemed by the Promoter or by any other prize-supplier involved with prize-redemption to be (i) damaged, (ii) counterfeit, (iii) copied, (iv) misprinted, (v) incomplete, (vi) illegible, (vii) reproduced/transmitted incorrectly, (viii) the result of a technical malfunction or (ix) handled, used, disclosed, offered for sale by an ineligible person.

An entrant’s sole remedy for a void Card/s will be (subject to availability) a replacement Card.

Nothing in these Rules shall affect the statutory rights of entrants.

The Promoter may (in its discretion) (i) decline to enter into any correspondence save as otherwise stated in these Rules, (ii) alter these Rules during the Promotion to the extent it considers necessary or desirable to maintain and preserve the integrity and reputation of the Promotion or the fair, effective or secure operation of the Promotion (and altered Rules will be notified and made available for review at mcdonalds.co.uk/monopoly/news), and (iii) perform any stated function in these Rules via an agent and the entrant shall be required to accept such performance as if it was directly by the Promoter.

Any person with a disability preventing compliance with any stated requirement for entrants to hand-write applications or envelopes to enter without purchase, or for details of personal data held about that person, a copy of the Rules, a list of prize winners or further details of prizes or otherwise, should contact the Promoter.
